ggCircuit Winter WAN Tournament

 

Official Rules

 

These rules (“Official Rules”) set forth the rules and regulations of the ggCircuit Winter WAN Tournament (the “Tournament”) administrated by ggCircuit, LLC. (“Administrator”).

 

Please read these Official Rules carefully before submitting an entry or participating in the Tournament. These Official Rules contain important information about eligibility to enter the Tournament, the rules of the Tournament and other important information.

 

By entering the Tournament, you accept these Official Rules and agree to be bound by their terms. If you do not agree with these Official Rules, please do not register for the Tournament.

 

1.       Eligibility

 

The Tournament is open only to legal residents of [Albania, Argentina, Australia, Bolivia, Brazil, Canada, Chile, Ecuador, France, Hungary, Iceland, India, Indonesia, Jordan, Lebanon, Malaysia, Malta, Mexico, Netherlands, New Zealand, Norway, Peru, Philippines, Poland, Qatar, Romania, Russia, Spain Sweden, Switzerland, Thailand, Turkey, United Kingdom and United States] who are sixteen (16) years of age or older as of January 10, 2019 (each a “Player”).   Players may be required to show proof of age and residence.  For Players under the legal age of majority in their country/state of residence, you are required to obtain consent from a parent or legal guardian to participate in the Tournament and the parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of Administrator.  IF YOU DO NOT SATISFY THESE REQUIREMENTS, YOU ARE NOT ELIGIBLE TO REGISTER AND/OR PARTICIPATE IN THE TOURNAMENT. All Players must have a valid e-mail address and it is Player’s responsibility to update Administrator of any change in their e-mail address.  Participation in the Tournament is subject to compliance with the requirements specified below.  Employees of Administrator, Participating LAN Centers, Epic Games, Inc. (“Epic”), or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Tournament and their immediate family (spouse, parents and step-parents, siblings, and step-siblings, and children and step-children) and household members (people who share the same residence at least three months out of the year) are not eligible.

 

Each Player must have a valid Fortnite account which is subject to the Fortnite End User License Agreement.

    

Participation constitutes Player’s full and unconditional agreement to these Official Rules and Administrator's decisions, which are final and binding in all matters related to the Tournament. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

Void where restricted or prohibited by law.

 

 

2.       Tournament Period

The Tournament will run January 10, 2019 through January 13, 2019 according to the schedule below (the “Tournament Period”) which is subject to change based on number of participants.

3.       How to Enter the Tournament 

 

Each Player must visit a participating ggCircuit LAN center (each a “Participating LAN Center”) to enter and compete in the Tournament.  A list of Participating LAN Centers can be found at https://docs.google.com/document/d/12z7x5ie6TS3Um6GGXrSux9i_RA4Y-WHPLCyM_sG8yMs/.  Participation will be first come, first served.  Players must obtain from a Participating LAN Center a 4-hour Tournament pass for each day they want to participate. Each 4-hour Tournament pass will include entry into 3 qualifying sessions. Players must also complete the Tournament registration form.  All Players will be required to have or create a free ggCircuit account (name, birthdate, email address and country will be required) and agree to these Official Rules. 

 

There is a limit of 768 Players per each Solo Event and 768 Players for the Duo Event.   Players may participate in the Qualifiers on all 3 days of the Tournament but may not enter multiple Regions. 

 

There is no fee to enter or compete in the Tournament.  However, each Player may be required to pay the Participating LAN Center a fee for computer usage during the Tournament. Any costs associated with computer usage, travel or other costs related to participation are the responsibility of the Player.  

 

4.       Tournament Play

 

The Tournament is divided into three Regions: Americas, Oceanic and Europe.  All Events will be run using the same format and number of Qualifiers/Championships in each Region. 

 

Solo Events:   There will be two Solo Events for each Region held over 2 days consisting of qualifying matches and 4 championship matches (2 per day).  Qualifiers will run back to back until all Players have competed in 3 qualifiers for the day. The top 4 Players (the last four Players alive) from each Qualifier will advance to compete in the 2 Solo Championships for that day/Region.  If the same person has a winning placement in more than 1 Qualifier, an alternate will be selected to advance to the Championship.  There is no advantage in qualifying more than once.  

 

Duo Events:  There will be 1 Duo event for each Region consisting of 2-Player teams competing in qualifying matches and 3 Championships.  Qualifiers will run back to back until all Teams have competed in 3 Qualifiers.  In each of the Qualifiers, the top 2 Teams (the last 2 Teams alive) from each Qualifier will advance to the 3 Championships for that Region. If the same Team has a winning placement in more than 1 Qualifier, an alternate Team will be selected to advance to the Championship.  There is no advantage in qualifying more than once.  The same winners from the Qualifiers will compete in all 3 Championships. 

 

 

5.       Tournament Administration & Conduct

·         Players must be ready to compete at least 10 minutes prior to any Qualifier and/or Championship.

·         Players competing in the Duo Event will need to play from the same center and must party up before the game starts.

·         Officials will be designated to preside over the Tournament and are responsible for enforcing the Official Rules.  Officials will be available to contact via live chat through the ggCircuit Discord server (https://discord.gg/KTrC7df).

·         Sportsmanship:  All Players will be required to uphold and observe a universal level of sportsmanship. Unsportsmanlike conduct includes, but is not limited to, racism, use of profanity, rude acts, vulgar acts, acts of belligerence, and disrespect of an Official. 

·         It is illegal to intentionally utilize any game exploits for the purpose of generating a competitive advantage.

·         Players/Teams agree they will not team up with other Players/Teams to gain a competitive advantage or otherwise impact the outcome of game play during the Tournament.

6.       Prizes

Players will be awarded prizes as follows.  All prizes are in USD.

Winning Players will also be required to provide certain payment information to Epic, including any required tax information forms, in order to receive the prizes. Epic may withhold payment of the prizes if the winning Player fails to provide the applicable payment forms to Epic in a timely manner. 

The prizes are provided “as is” and without any warranty of any kind.  All details and other restrictions of prizes not specified in these Official Rules will be determined by Administrator in its sole discretion. No prize substitution, except as allowed by Administrator who reserves the right to offer a prize of equal value.  The total prize value of all prizes for the Tournament is $25,000 USD. 

PRIZES ARE SUBJECT TO APPLICABLE FEDERAL, STATE AND LOCAL INCOME TAX AND IT IS THE RESPONSIBILITY OF EACH WINNING FINALIST TO (I) CHECK WITH HIS OR HER LOCAL TAX ADVISOR TO DETERMINE WHICH TAXES APPLY TO HIM OR HER AND (II) PAY SUCH TAXES TO THE APPROPRIATE TAX AUTHORITY.  Epic will withhold tax at the backup withholding rates in effect for US and non-US residents.  Prize income and tax withholding will be reported on forms 1099-MISC for US residents and 1042-S for non-US residents.  Epic will determine the payment method for the prizes in its sole discretion and all payments will be made directly to the winner.  

 

7.             Notification and Responsibilities of Winners
The winning Players (those that are eligible for a prize) will be notified within forty-eight (48) hours of the completion of the Tournament and may be required to respond (as directed) to the notification within seventy-two (72) hours of attempted notification. The failure to timely respond to the notification may result in forfeiture of the prizes; and, in such case, Administrator may choose the next highest scoring winner.  Winners will be required to agree to the Certificate of Eligibility and Release (“Release”), which includes an acceptance of these Official Rules and a release of liability, to the extent permissible by law.  Entry into this Tournament constitutes prize winner’s agreement to sign such document.  If required by law, the winner will be required to execute all applicable tax releases. The Release and tax release must be provided to Epic within 5 (five) days of notification attempt or the prize will be forfeited.  Prize may be awarded to alternate winner or the prize may be forfeited, if any requested document is not returned by the deadline, or if prize notification or prize is returned as undeliverable.  The prize will be delivered within 45 days of winner being verified. Epic will not deliver a prize to any person other than the winner. 

8.             Use of Information
The information collected to enter the Tournament will be used to contact you if you are chosen to receive a prize. Players agree that Administrator, Epic, Participating LAN Centers and their agents and assignees may use his or her name, contact information (email, address, phone), tag, alias, game account, game stats, likeness, image, voice, video and biographical information to administrate, market and promote the Tournament.  Administrator reserves the right to utilize broadcasting which may include any media. By registering for the Tournament, each Player consents to allow the Tournament game play and Player's alias to be used.  In addition, any such information may be used and disclosed as set forth in the ggCircuit privacy policy located at http://media.ggleap.com.s3.amazonaws.com/legal/ggCircuit_Privacy%20Policy.htm Please note that by participating in the Tournament and accepting these Official Rules, you acknowledge and accept the use of your data for the purposes set out above and that your personal data may be transferred, transmitted and/or stored in the United States. If you wish to request that we no longer use your information to provide you services, contact us at privacy@ggcircuit.com .We will respond to your request within 30 business days. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

All Player entries will be provided to Epic and such information will be subject to Epic’s privacy policy located at https://www.epicgames.com/site/en-US/privacypolicy. 

9.             General Release

To the extent permitted by applicable law, Administrator, Epic, Participating Centers, and each of their respective parents, affiliates, subsidiaries and advertising and promotion agencies (collectively, “Tournament Entities”), and all of their respective officers, directors, agents and employees will not be responsible for any of the following insofar as they are beyond their reasonable control: (a) technical failures of any kind, including, but not limited to telephone, electronic, hardware, software, network, Internet, or any other computer and communications related malfunctions or failures; (b) any Tournament disruptions, injuries, losses or damages caused by events beyond the control of Administrator with the exception of personal injury or death caused by negligence; or (c) any technical or human error such as typographical, printing, or administrative errors in any materials associated with the Tournament. Unless prohibited by applicable law, Players acknowledge that the prizes will be awarded “as is” and that neither Administrator nor Epic makes any warranty, guarantee or representation of any kind, expressed or implied, concerning a prize or regarding the use, value or enjoyment of the prize. 

 

By entering the Tournament, Players agree to release, discharge, indemnify, and hold each of the Tournament Entities, and each of their officers, directors, employees, agents and representatives, harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the Tournament or participation in any Tournament-related activity (including, without limitation, travel to/from such activity), or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Tournament, including, without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
